Terms of Service

About these terms

These terms are an agreement between you and Living History, LLC ("we" or "us"), which runs Living History at livinghistory.app. By creating an account, buying a plan or message pack, or chatting with a historical figure, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Living History.

Who can use Living History

Living History is for adults. You must be at least 18 years old, or the age of majority where you live if that's higher, to create an account, buy anything, or use the chat.

Parents, guardians, teachers, and other adults may explore Living History with younger people or use it in front of a class or group, as long as the adult leads the conversation from their own account and decides what to show. People under 18 must not create accounts or type into the chat themselves. If we learn that an account belongs to someone under 18, we'll close it and delete its data.

AI conversations

Every figure in Living History is an AI simulation, not the real person. Replies are generated by artificial intelligence (currently Anthropic's Claude models) and draw on the sources listed in the Sources menu in the app, such as the National Park Service, the Nobel Prize, and Wikipedia, along with corrections our team makes. Sources may be added, removed, or limited to certain plans over time.

  • Replies can be wrong. They may contain factual errors, anachronisms, or invented details, and figures speak with the opinions and blind spots of their own time. Check anything important against reliable sources before you rely on it, quote it, or cite it.
  • Figures speak from inside their own lifetime. They don't know about events after their death, including how or when they died.
  • History includes difficult subjects. Conversations may touch on war, violence, slavery, discrimination, and other mature themes.
  • Pictures are off until you turn them on. Figures can illustrate conversations with images from public archives such as Wikipedia, the Library of Congress, Europeana, and Wikimedia Commons. On every plan, these appear as locked previews. On plans that include pictures (currently Silver and Gold), they stay hidden until the account owner turns them on by entering a code sent to the account's email address. We filter out nudity and graphic images, but no filter is perfect, so archival pictures may still include mature or upsetting material. You can turn pictures off at any time from your account menu.
  • No sexual or self-harm content. Figures won't engage in sexual or romantic role-play, and won't describe methods of self-harm or suicide, however a request is phrased.
  • Achievement summaries are written by AI. The "Known for" list is summarized by AI from Wikidata and Wikipedia. It highlights what a person is best known for and may leave things out or get details wrong.
  • Life maps are assembled with AI. The map of places in a figure's life is put together by AI from Wikidata and Wikipedia, with every place checked against real map coordinates. Dates and descriptions can still contain mistakes.
  • It isn't professional advice. Nothing a figure says is legal, medical, financial, or other professional advice.

Your account

You need an account with a verified email address to search for and talk with figures. You can sign in with a one-time code we email to you, or with a password if your account has one. Give accurate information when you sign up, keep access to your email and any password private, and let us know at livinghistoryapp@gmail.com if you think someone else has accessed your account. You're responsible for what happens under your account. Accounts are for one person and can't be shared or resold.

Plans, payments, and renewals

  • Free messages. Each new account gets 5 free messages once its email address is verified. The free allowance is one per person: disposable or temporary email addresses can't be used, and we may close accounts created to get extra free messages. We may change the free allowance.
  • Silver and Gold subscriptions. These are monthly subscriptions at the price shown before you pay. They renew automatically every month, and your payment method is charged at the start of each billing period, until you cancel. Each plan includes a monthly message allowance and the features listed on the plans screen.
  • Message packs. Packs are one-time purchases of a set number of messages. They aren't subscriptions and don't renew. Unused pack messages stay on your account while it's open.
  • Payments. Payments are processed by Stripe. Prices are in US dollars unless shown otherwise, and your bank may add currency conversion or foreign transaction fees. Any taxes shown at checkout are added to the price.
  • Price changes. If we change the price of a subscription, we'll tell you by email at least 30 days before it applies to your next renewal, so you can cancel first if you prefer.
  • Promo codes. Promo codes are subject to any conditions shown with them and have no cash value. A plan granted by a free promo code ends as soon as it's cancelled.

Cancelling

You can cancel a subscription at any time from the Subscription option in the account menu. After you cancel, you won't be charged again, and you keep your plan until the end of the period you've already paid for, then move to the free plan. You can also email us at livinghistoryapp@gmail.com to cancel.

Refunds

Because messages are delivered instantly, we generally don't refund partial subscription periods or messages you've already used. If you believe you were charged by mistake, or something went wrong with a purchase, contact us at livinghistoryapp@gmail.com within 30 days and we'll look into it.

Nothing in these terms limits any rights you have under the consumer protection laws where you live, including any legal right to cancel a purchase or receive a refund.

Acceptable use

Please use Living History for learning, curiosity, and conversation. You agree not to:

  • use it if you're under 18, or let someone under 18 use your account;
  • break the law, or harass, threaten, or harm anyone;
  • try to get sexual content, content that sexualizes minors, or instructions for weapons or other serious harm;
  • try to get around message limits, safety measures, or payments, for example by creating multiple accounts;
  • scrape, copy, or automate access to the service, or use its output to train other AI models;
  • present AI replies as the genuine words of a historical figure or as the work of a human, or use them to mislead people; or
  • use the service in a way that violates Anthropic's Usage Policy, which applies to the AI models behind Living History.

Your content and ours

You keep ownership of the messages you write. You give us permission to store and process them, and to send them to our service providers, only as needed to run Living History for you, as described in our Privacy Policy.

You may use AI replies and your notebook for personal, educational, and non-commercial purposes, remembering that replies can be inaccurate. Pictures and biographical text shown in the app come from sources such as Wikipedia, Wikimedia Commons, the Library of Congress, Europeana and the institutions in it, the French National Library, and Open Library, and remain subject to their owners' licenses. The Living History name, design, and software belong to us.

Changes and availability

We're always improving Living History, so features, AI models, and allowances may change. We'll try to keep the service available, but it may sometimes be interrupted, and we don't promise it will always work without errors. If we ever shut Living History down, we'll give paying subscribers reasonable notice and stop future charges.

Suspension and closing accounts

You can stop using Living History and ask us to delete your account at any time by emailing livinghistoryapp@gmail.com. We may suspend or close an account that breaks these terms, puts others at risk, or is required to be closed by law. If we close your account for a reason other than your breaking these terms, we'll refund any unused part of a subscription you've paid for.

Disclaimers and liability

To the extent the law allows, Living History is provided "as is," without warranties of any kind, and we aren't responsible for decisions you make based on AI replies. To the extent the law allows, our total liability to you for any claim relating to Living History is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you, and they don't affect rights that can't be limited by law.

Governing law

These terms are governed by the laws of [Country and state/region whose law governs these terms], without regard to conflict of law rules. If you're a consumer, you also keep the protection of any mandatory laws of the place where you live, and you may bring claims in the courts where you live if that law allows.

Changes to these terms

We may update these terms from time to time. If a change is significant, we'll tell you by email or in the app before it takes effect, and we may ask you to agree again. The date at the top of this page shows when they last changed.
